Recent changes to The Anti-Money Laundering and Countering Financing of Terrorism Act 2009 mean that from 1 July 2018, lawyers are required to comply with its requirements. The activities conducted by this firm are captured by the Act and as such there are a number of updates on the information we collect.
The legislation means we have to verify each individual and the entities that are involved in particular matters.
To be absolutely sure we comply and protect your interests as well as ours we have to conduct what is known in the Act as Customer Due Diligence or CDD.
While this isn’t a lot different to what we do now, there are a few extra steps we need to take to verify to the satisfaction of the law, each party. These include:
To confirm these details, documents such as your passport, driver’s license or your birth certificate, and documents that show your address, such as a current bank statement will be required. We will also need confirmation of your IRD number and/or the IRD number of the entity being represented.
Trusts, companies, partnerships and so on will be covered as well as the beneficiaries of these.
From time to time there may be additional information required. The nature of the business with us and the source of funds for the matter are just parts of this.
If we are not able to obtain the required information from you, it is likely we will not be able to act for you.
Before we accept instructions from you we will let you know what information is required in detail and take the necessary copies for the file and the Act.
